- YellowClose supervision
- How AI is used
- Build a chronology of what was learned, when, and by whom, from the incident file the lawyer supplies. Do not write the report that is sent to the Commission.
- What the lawyer must review
- You write and send the report. 15 U.S.C. § 2064(b) requires a manufacturer, distributor or retailer who obtains information that reasonably supports the conclusion of a listed failure, a defect that could create a substantial product hazard, or an unreasonable risk of serious injury or death, to inform the Commission immediately, unless that person has actual knowledge that the Commission has been adequately informed. Motor vehicle equipment as defined in 49 U.S.C. § 30102(a)(7) is excluded. A substantial product hazard is defined in § 2064(a). Do not wait for a finished internal investigation if the information already meets the statute.
