Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Table each claim, the product it describes, and the evidence file the lawyer supplies for that claim. Do not rewrite the advertising.
- What the lawyer must review
- FTC Act § 5 declares unfair methods of competition, and unfair or deceptive acts or practices, in or affecting commerce unlawful. The Commission’s authority has stated exceptions, including banks. Lanham Act § 43(a), 15 U.S.C. § 1125(a)(1), reaches a false or misleading description or representation of fact which, in commercial advertising, misrepresents the nature, characteristics, qualities or geographic origin of goods, services or commercial activities. You decide whether a claim is deceptive and whether a private plaintiff has a Lanham Act case. State UDAP statutes are separate. Open the one that applies.
