List the product, who gives the warranty, what that person will do if there is a defect, at whose expense, and for how long, as the draft states those points. Do not write the warranty.
What the lawyer must review
15 U.S.C. § 2302(a) requires a warrantor who gives a written warranty on a consumer product to disclose the terms fully and conspicuously, in simple and readily understood language, to the extent required by Commission rules. Those rules may require items that include the warrantor's name and address, who receives the warranty, the parts covered, what the warrantor will do in the event of a defect, malfunction or failure to conform, at whose expense, and for what period. Section 2302(b)(2) says the chapter does not authorise the Commission to prescribe how long a written warranty lasts or to require that a product be warranted. The full and limited designations are in the next section, which was not opened. Do not copy any Australian mandatory wording into the warranty. You write it.
