Review a leaving-care plan against the statutory requirements

- How AI is used
- From the plan and the file, list the young person's age, when care is due to end, the goals, the supports named, and what each person is recorded as agreeing to do. Note whether the plan deals with possessions and personal information such as school reports, medical reports and photographs. Do not decide that the plan meets the statute, and do not rewrite it.
- What the lawyer must review
- The lawyer decides whether the plan meets the local requirements. In New South Wales, leaving care means the young person is no longer formally in the care of the Minister, which usually happens at 18. It does not require the young person to move out. The NSW Government page says a leaving care plan sets out goals, the support and services needed, and what each person has agreed to do, and that the plan stays in place until the young person turns 25. The young person is entitled to keep possessions, including aids and furniture bought for them, and to access personal information held by the carer. The same page points carers to sections 61, 165 and 166 of the Children and Young Persons (Care and Protection) Act 1998 for their rights and responsibilities. The lawyer reads those sections and the local leaving-care provisions before treating the plan as sufficient. Other states are not described here.

Checklist
- Check the young person's age and the end of the care order against the order, not against the plan alone.
- Confirm goals, supports and agreed actions are each present or marked missing.
- Confirm possessions and personal information are addressed before the lawyer treats the plan as complete.
