Assess an information-sharing request about a child's safety
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the request and the file, record who asked, whether the requester and the holder are prescribed bodies, what information is asked for, and the child-protection purpose stated. Do not decide to disclose or to refuse, and do not write the refusal.
- What the lawyer must review
- The lawyer decides whether Chapter 16A applies, whether the information relates to the safety, welfare or wellbeing of a child or young person, whether a refusal ground is open, and what may be disclosed. A prescribed body may provide information under section 245C or request it under section 245D. The information must be used for a child-protection purpose, such as a decision, an assessment, a plan, risk management, an investigation, or coordinated services. It must not be passed to a body that is not prescribed. A prescribed body may refuse where it reasonably believes the information would prejudice care proceedings or endanger a person's life or physical safety, under section 245D(4). A refusal must be in writing with reasons, under section 245D(5). The lawyer writes that notice. Other states have their own schemes, which this task does not describe.

Checklist
- Check the requester against the prescribed-body list before any disclosure is described as available.
- Confirm the stated purpose is a child-protection purpose, and that the information is not marked for release to a body that is not prescribed.
- If refusal is in question, confirm the written reasons address section 245D(4) and are written by the lawyer.
