- Record the pilot's name and any remote pilot certificate number the file shows. Do not say the person may manipulate the controls and do not call the certificate an exclusion.
- What the lawyer must review
- You decide whether the person may fly. Section 107.12(a) says that, except as paragraph (c) provides, no person may manipulate the flight controls of a small unmanned aircraft system unless that person has a remote pilot certificate with a small UAS rating and satisfies § 107.65, or is under the direct supervision of a remote pilot in command who can immediately take direct control. Section 107.12(b) says that, except as paragraph (c) provides, no person may act as remote pilot in command without that certificate and without satisfying § 107.65. Paragraph (c) allows the Administrator, consistent with international standards, to authorize an airman to operate a civil foreign-registered small unmanned aircraft without an FAA-issued certificate. The operative text of § 107.65 was not set out beyond its heading, so you open it before you say a certificate is current. An excluded-category accreditation is not this certificate.
