- How AI is used
- From the ownership papers, list the owner, whether the file says the aircraft is registered in a foreign country, and which § 47.3(a) category the papers appear to describe. If a fact is missing, say so. Do not decide that the aircraft may be registered.
- What the lawyer must review
- You prepare what is sent to the Registry. Section 47.3(a) provides that an aircraft may be registered under 49 U.S.C. § 44103 only when it is not registered under the laws of a foreign country and it is owned by a United States citizen, or by an individual citizen of a foreign country lawfully admitted for permanent residence, or by a corporation that is not a United States citizen but is organized and doing business under the laws of the United States or a State and the aircraft is based and primarily used in the United States, or it is an aircraft of the United States Government or of a State, the District of Columbia, a territory or possession, or a political subdivision. Section 47.3(b) provides that no person may operate an aircraft eligible for registration under 49 U.S.C. §§ 44101 to 44104 unless the owner has registered it, or it carries the temporary authorization required by § 47.31(c), or it is an aircraft of the Armed Forces. Section 47.31(c) was not opened. Section 44103 was not opened as its own page. You decide eligibility. Formal Opinion 512 applies to the ownership papers.
