Record the facts of a claimed small-UAS in-flight emergency
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Record what the pilot's note says the emergency was, the rule the note says was departed from, and whether the file contains a written report. Do not say the departure was allowed.
- What the lawyer must review
- You decide whether § 107.21 applies. It says that in an in-flight emergency requiring immediate action, the remote pilot in command may deviate from any rule of part 107 to the extent necessary to meet that emergency. A pilot who deviates must, upon the Administrator's request, send a written report of the deviation. The report is not required by the section unless the Administrator requests it. The tool does not write that report and does not decide that immediate action was required. Section 107.200 waivers are a different path. They are not this emergency deviation. Model Rule 1.4(b) is the explanation to the client. Formal Opinion 512 requires you to verify the note.
