Review an award for confirmation or vacatur points
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Extract the date of the award, the court named in the clause, the relief, and any passage that may fit a § 10 ground. Do not draft a petition.
- What the lawyer must review
- If the parties agreed that judgment shall be entered on the award and named the court, a party may apply to that court within one year after the award for an order confirming it, and the court must grant the order unless the award is vacated, modified or corrected under §§ 10 and 11 (9 U.S.C. § 9). If no court is specified, application may be made to the United States court in the district where the award was made. Section 10(a) lists vacatur for an award procured by corruption, fraud or undue means; evident partiality or corruption in the arbitrators; misconduct in refusing a postponement or in refusing to hear pertinent evidence, or other misbehavior that prejudiced a party; and arbitrators who exceeded their powers or so imperfectly executed them that a mutual, final and definite award was not made. A Convention award is confirmed under § 207 within three years, unless a Convention ground for refusal applies. The lawyer decides which chapter applies and writes any petition. Rule 11 applies to that petition.
