Tender of a claim or suit to a liability insurer

A notice to a liability insurer that a claim or a suit has been made, enclosing the papers the lawyer marks. New York Insurance Law § 3420 is cited only for policies issued or delivered in New York, and only after the lawyer reads the exception in subsection (g).

When to use it

Use when an insured must tell a liability insurer about a claim or a suit. Do not use it as a proof of loss. Do not use the New York sentences for a policy that was not issued or delivered in New York.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may enclose the claim or the pleading the lawyer marks and copy the policy number from the declarations. The lawyer decides where notice must go and whether section 3420 applies.

AI may

  • Attach the papers the lawyer lists and copy the policy number from the declarations
  • Use the notice address printed in the policy
  • Flag a New York legal conclusion on a policy that is not identified as issued or delivered in New York

AI must not

  • Must not decide that the policy covers the claim
  • Must not concede that notice is late
  • Must not send the letter or file a declaratory judgment action

The lawyer checks

  • The notice address and the policy number match the policy
  • Section 3420 is used only if the lawyer decides the policy is one the section covers, after reading subsection (g)
  • The letter is not a sworn proof of loss
