When to use it
Use when a principal of a Victorian government school is deciding whether to suspend a student and, if so, what the notice to the student and relevant person must contain.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
The tool assembles the decision record and the notice from facts the principal supplies, and the principal checks every ground and the period before the notice is given.
AI may
- Set out the grounds and the where-and-when limits in the words of the policy.
- Record the period, whether it is immediate, and whether regional director approval is required on the guidance's tests.
- Draft the notice so that it states the reasons, the school days, and whether a learning plan and return-to-school plan are attached.
AI must not
- Do not decide that the behaviour meets a ground.
- Do not delegate the decision to a person who is not the principal or acting principal.
- Do not reproduce the department's staff-login templates. They were not opened.
The lawyer checks
- The principal, or acting principal, of the student's enrolled school makes the decision. The policy says this authority cannot be delegated.
- Apply the guidance on a period longer than 5 days, not only the shorter sentence on the policy page. Both pages were opened and they are not worded the same way.
- Where the behaviour is related to a disability, the guidance says the principal should contact Legal Division before the final decision. This notice does not replace that contact.
- Ministerial Order 1125 was not opened. The policy says it defines the grounds and process.
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
