When to use it
Use when a client of a plaintiff injury practice authorises a new firm to receive the file on completion or termination of the retainer. It is not the confidentiality undertaking for an expert or reviewer, and it is not the letter about what a departing solicitor may copy.
Used for these tasks
- Give the client their documents on request when the engagement ends unless an effective lien applies
- Check a lien over documents that are essential to current proceedings
- Review an outgoing document for hidden metadata before it leaves the practice
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
The tool can prepare the letter from the authority and the list of documents the lawyer has marked. The lawyer decides the lien, what is essential to current proceedings, and the secure method.
AI may
- Draft the letter once the lawyer has entered the client's authority and the document list
- Set out the two rule 15.1 paths as alternatives the lawyer chooses between
- Leave the lien answers blank until the lawyer marks them
AI must not
- Must not decide that a lien exists, or that the documents are essential to current proceedings
- Must not describe what reasonable security is
- Must not send health records to an address the lawyer has not checked
- Must not state a fee for copying
The lawyer checks
- The client's authority for this firm to give the documents to the new firm is on the file
- The lien questions are answered before anything is withheld or delivered up
- The receiving address for health records was confirmed with the new firm before the records were sent
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
