When to use it

Use when class discovery will include names, addresses, phone numbers, emails or account numbers. Do not use a mark on that data as permission to file it publicly or to contact class members for a purpose outside the case.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may adapt the stipulation from the data fields the lawyer lists. The lawyer decides who may see contact data and whether it may be used to communicate with class members.

AI may

  • Insert the data fields from the lawyer's list into the definition of covered data
  • State the lawyer's choice on whether contact data may be used for case communications
  • Flag any clause that would let a party file unredacted account numbers because they were marked confidential

AI must not

  • Must not decide that absent class members have consented to disclosure or to contact
  • Must not draft a class notice or an opt-out form in this stipulation
  • Must not file the stipulation

The lawyer checks

  • The fields match what is actually being produced
  • Use of contact data is limited to what the lawyer has approved, and solicitation is addressed
  • Rule 5.2 redaction and the court's sealing rules are left in place
