List the facts of a creditor's claim for the response
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the claim and the file, list the creditor, the amount if printed, the date of the claim, the date notice was mailed or delivered if the file shows it, and the letters date. Write no allowance, no rejection, and no letter.
- What the lawyer must review
- You decide whether the claim is timely and you write the response. Probate Code § 9100(a) requires the claim before the later of four months after letters are first issued to a general personal representative, or 60 days after notice of administration is mailed or personally delivered to the creditor. The 60-day paragraph does not extend Code of Civil Procedure § 366.2. Section 9100(c) does not extend or toll any other limitation period or revive a barred claim. Section 9050 is the notice duty, including the rule that knowledge of a creditor includes awareness of a demand for payment. You compute the later date.
