- How AI is used
- The rule is state law, and the lawyer must confirm which state's law governs. For example, Florida Statutes s 732.505 and s 732.506 state revocation by a later writing and by a physical act. From the will file, list each later will, each writing that says it revokes an earlier will, and any described physical change to the original, with the date. Do not say the will is revoked.
- What the lawyer must review
- The rule is state law, and the lawyer must confirm which state's law governs. For example, Florida Statutes s 732.505 and s 732.506 are the only revocation sections used in this check. A later writing revokes only if it is executed with the formalities required for a will and declares the revocation, unless it is a subsequent inconsistent will or codicil, in which case the revocation goes only as far as the inconsistency. A physical act revokes only with the intent and for the purpose of revocation, by the testator or by someone in the testator's presence and at the testator's direction. The electronic-will sentence in section 732.506 requires clear and convincing evidence. The tool lists what is in the file. It does not say the will is revoked.
