Work out which body still holds a victims file after the scheme changes hands

Key facts

How AI is used
From the old file, record the date the application was lodged, the body named on it, whether an interim or final award was made, and whether the application was withdrawn and on what date. Do not say the file can be moved or that a fresh application is allowed.
What the lawyer must review
  • The lawyer decides which body still has the file and whether a fresh application is barred.
  • Check lodge, award and withdrawal dates against the old form, not a recollection.
  • A final award is not the same as a pending application. Do not treat them alike.
  • Do not use one State's handover date on a file from another State.

Checklist

  1. Check the lodge date, the body and any withdrawal date against the old form.
  2. If a final award or a refusal is on the file, do not start a fresh application until the lawyer has applied the bar.
  3. Use 18 November 2024 only for a Victorian tribunal file. Do not write that date on another State's file.
  4. For a Victorian variation, apply the 6-year period or the age-24 period from the page, and record who now decides it.
