- What the lawyer must review
- 34 U.S.C. § 20102(b)(1)(A) includes, in the compensation an eligible program offers, medical expenses attributable to a physical injury resulting from a compensable crime, including expenses for mental health counseling and care. The term medical expenses also includes, to the extent provided under the eligible program, eyeglasses or other corrective lenses, dental services and devices, prosthetic devices, and services rendered in accordance with a method of healing recognized by the law of the state. 18 U.S.C. § 3663A(b)(2)(A), where that section applies, requires restitution for the cost of necessary medical and related professional services relating to physical, psychiatric, and psychological care, including nonmedical care and treatment rendered in accordance with a method of healing recognized by the law of the place of treatment. You decide which statute applies and whether the expense is attributable to the injury.
