- How AI is used
- Index each record by date, author and the expense or injury it relates to. Write nothing that goes into the application.
- What the lawyer must review
- The index is a working paper. The application is a later task. 34 U.S.C. § 20102 describes the expense categories a federally eligible program must cover. It does not make every record compensable. Model Rule 1.6 and Opinion 512: medical and counselling records do not go into a public tool. The Crime Victims’ Rights Act, 18 U.S.C. § 3771, is a separate set of rights in the criminal case. Do not treat the index as a notice of appearance or a request to be heard.
