What the lawyer must review
34 U.S.C. § 20102(e) provides that if compensation paid by an eligible crime victim compensation program would cover costs that a federal program, or a federally financed state or local program, would otherwise pay, the compensation program shall not pay that compensation, and the other program shall make its payments without regard to the compensation program. The section also states the costs an eligible program offers, including medical expenses (including mental health counseling and care), loss of wages attributable to a physical injury, and funeral expenses attributable to a death, each resulting from a compensable crime. It does not state a dollar cap. 18 U.S.C. § 3663A is a separate restitution order at sentencing for an offense described in that section, not a compensation-program payment. You decide which instrument applies to each cost.
