- What the lawyer must review
- 18 U.S.C. § 3663A(a) requires the court, when sentencing a defendant convicted of an offense described in subsection (c), to order restitution to the victim or, if the victim is deceased, to the victim's estate. The victim is a person directly and proximately harmed as a result of the commission of the offense. For property, the order shall require return of the property or, if return is impossible, impracticable, or inadequate, payment of the greater of the value on the date of damage, loss, or destruction or the value on the date of sentencing, less the value of any part returned. For bodily injury the order covers necessary medical and related professional services, necessary physical and occupational therapy and rehabilitation, and income lost as a result of the offense. 18 U.S.C. § 3771(a)(6) separately states the right to full and timely restitution as provided in law. You decide whether subsection (c) applies and what is necessary.
