- How AI is used
- List the funeral and related costs, the date of death, and whether a federal conviction or a state compensation application is in the file. Do not state an award amount.
- What the lawyer must review
- An eligible crime victim compensation program under 34 U.S.C. § 20102(b)(1) offers compensation to victims and survivors of victims of criminal violence, including drunk driving and domestic violence, for funeral expenses attributable to a death resulting from a compensable crime. The federal grant is 75 percent of amounts awarded during the preceding fiscal year, other than amounts awarded for property damage. The section does not set the dollar amount of a funeral award. Separately, 18 U.S.C. § 3663A(b)(3) requires a restitution order, in the case of an offense resulting in bodily injury that results in the death of the victim, to pay an amount equal to the cost of necessary funeral and related services, when the section applies under subsection (c). You decide which path is open and which costs are necessary funeral costs.
