How AI is used
From the settlement or award and the repayment figure the lawyer accepts, set out the lump sum, any periodic compensation end date, and divide only if the lawyer has supplied the income-test limit. Do not add a superannuation disability payment into the lump sum. Do not write the advice.
What the lawyer must review
  • You decide whether the 50 per cent rule or an economic-loss amount applies to this lump sum.
  • You supply the single-rate pension income-test limit for the settlement date.
  • A disability payment from a superannuation fund is not compensation. Leave it out of the lump sum.
  • Use a firm-controlled tool. Check ASCR r 9, APP 11 and any notifiable breach.

Services Australia says the number of weeks is 50 per cent of the lump sum divided by the single-rate pension income-test limit at the date of settlement. If the lump sum was awarded by a court or tribunal after a contested hearing, the calculation page uses the amount awarded for loss of earnings. The period usually starts on the date of injury, or the day after periodic compensation such as weekly workers' compensation stopped. Lump sums for the same injury are added only if one or more has a loss of earnings. The lump-sum page treats them as one sum if one has an economic-loss component. The income-test dollar limit is not printed on the calculation page.

The lump-sum page lists rehabilitation, economic loss, non-economic loss, solicitors' costs, pain and suffering, impairment and medical expenses as components that may be in the sum. A global sum without an earnings split is still treated as in respect of lost earnings. The lawyers' page says a disability payment from a superannuation fund is not compensation for social security purposes. Workers' compensation and motor-vehicle third-party payments are examples of payments that must be told.
