From the claim and the payment record, list the Queensland payer, whether a compensation-affected payment was received since the injury, and whether a preliminary notice or a recovery notice is on the file. Do not complete the form.
What the lawyer must review
  • You decide whether the payer is a workers' compensation insurer, a motor-accident insurer, or another payer.
  • Do not release funds while a preliminary or recovery notice is outstanding without written approval.
  • A superannuation disability payment is not on the list of compensation to notify.
  • You complete the notice, not the tool. Use a firm-controlled tool. Check ASCR r 9, APP 11 and any notifiable breach.

Health, wage and scheme records stay in a firm-controlled tool. Check ASCR r 9, APP 11, and whether a disclosure is notifiable under the Privacy Act 1988 (Cth).

Services Australia says a lawyer, insurer or payer must tell the agency about a claim or payment under a state scheme, including workers' compensation and motor-vehicle third-party schemes, where it is wholly or partly for lost earnings or lost capacity to earn. A notice under section 1182 or 1184 means the payer cannot pay without written approval. If no preliminary notice was served, the page says there is no obligation under the Social Security Act to seek approval, though it may still be sought. Customers must tell the agency within 7 days after the day they become aware they have received, or will receive, a compensation payment. Forms named on the page are the lump-sum advice, the periodic-payment advice, and the personal sickness and accident claim form.

Social Security Guide 6.4.2 says a compensation payer or insurer must notify Centrelink in writing within 7 days of the later of becoming liable to pay compensation or being served with a preliminary notice. A payer who releases funds against a served notice remains liable unless the Commonwealth has been paid or the payer has been released. That 7-day payer rule is not the customer's 7-day rule.
