How AI is used
From the chatbot script the lawyer supplies, list each field the script asks for and the purpose the script states. Leave a blank where the script states no purpose. Do not clear the script for use.
What the lawyer must review
If the firm or the client is a business that controls the collection, section 1798.100 requires notice at or before collection and requires the collection to be reasonably necessary and proportionate. A chatbot that asks for facts about a legal matter also takes in information relating to a representation. Model Rule 1.6 prohibits revealing that information unless the client gives informed consent, the disclosure is impliedly authorised, or paragraph (b) permits it. Opinion 512 says not to put that information into a tool whose disclosures you have not checked. You decide whether the script may be used.
