- How AI is used
- Record the change the client wants, whether the file identifies a mandatory element, and how many amendments of that element the file says have already occurred this calendar year. Write no advice that an amendment will be adopted, and do not initiate one.
- What the lawyer must review
- Government Code section 65358(a) provides that the legislative body may amend all or part of an adopted general plan if it deems the amendment in the public interest. The amendment is initiated in the manner the legislative body specifies. A legislative body that permits a person to request an amendment may require a deposit of the estimated cost of preparing it. Section 66016, which that sentence refers to, was not opened. Subsection (b) provides that, except as subdivision (c) or (d) provides, no mandatory element shall be amended more than four times in a calendar year, and each amendment may include more than one change. Subsection (c) takes a residential development out of that limit where at least 25 percent of the units will be occupied by or available to persons and families of low or moderate income as defined in Health and Safety Code section 50093, which was not opened. Subsection (d) says the section does not apply to adoption of an element, or to an amendment to comply with a court decision under the article commencing at section 65750, with section 65302.3(b), or with Public Resources Code section 30500(b). Those provisions were not opened. Section 65850, the zoning-ordinance power, is not this amendment power. You decide the public interest and whether an exception applies.
