How AI is used
From the client's points and the document being commented on, draft a comment with a heading for each point and a citation slot the lawyer will fill. Mark any fact that is not in the instructions.
What the lawyer must review
For a major federal action, 42 USC section 4332 requires the detailed statement and the comments of agencies authorised to develop and enforce environmental standards to be made available to the public. For a dredge-or-fill permit, 33 USC section 1344 requires notice and an opportunity for public hearings before the Secretary issues the permit. A local hearing is a creature of the local ordinance under a zoning power such as Government Code section 65850. You sign the comment. Every factual sentence has to be in the record you have read. CEQ's government-wide NEPA regulations were removed effective 8 January 2026, so the comment period and the document names come from the lead agency's procedures and the statute, not from 40 CFR parts 1500 to 1508. Opinion 512 and Rule 11 if the comment later becomes part of a court filing.
