Checklist

  1. An accident in Victoria is covered whether or not the vehicle is registered in Victoria. A non-resident injured in Victoria is covered.
  2. An accident outside Victoria is covered if it involves a Victorian-registered vehicle and the injured person is a Victorian resident or an occupant of that vehicle. A non-resident is covered outside Victoria only as an occupant of a Victorian-registered vehicle.
  3. The policy's example of a non-resident pedestrian, hit outside Victoria by a Victorian-registered vehicle, limits that person to the benefits of the place of the accident.
  4. If the person can claim in another place, the Commission must deny or stop compensation or damages once that claim is accepted, compensation or damages are paid, an award is entered, the claim is settled, a payment into court is accepted, or an action for damages is commenced.

Travel insurance or personal-accident insurance does not stop the Commission accepting a claim. The deny-or-stop rule is the list above.

The common-law policy assesses an overseas visitor's damages claim under the legislation of the place of the accident. When that place is Victoria, it uses the same rules as for a resident.
