How AI is used
From the diagnoses and the work facts the lawyer lists, set each condition of compensation in Labor Code § 3600(a) against the fact in the file that is said to meet it, or mark the fact as missing. Do not decide that compensation is payable. State law governs, and the lawyer confirms the governing state. For example, California.
What the lawyer must review
California Labor Code § 3600(a) makes the employer liable for compensation, in lieu of any other liability except as §§ 3602, 3706, and 4558 specifically provide, without regard to negligence, for an injury arising out of and in the course of the employment when the conditions of compensation concur. Those opened conditions include service growing out of and incidental to the employment, proximate cause by the employment, and exclusions for intoxication by alcohol or the unlawful use of a controlled substance, intentional self-infliction, willfully and deliberately causing one’s own death, being the initial physical aggressor in an altercation, a convicted felony or specified crime, and voluntary off-duty recreational activity that is not a reasonable expectancy of the employment. You decide whether the conditions concur. There is no national significant-injury gateway. State law governs, and the lawyer confirms the governing state. For example, California.
