Checklist

  1. Supreme Court Practice Direction 15 of 2018: the application and supporting material, other than the opinion, are served on the Public Trustee five business days before the hearing, unless an authorised officer has agreed in writing to a shorter period. An existing administrator or guardian under the Guardianship and Administration Act 2000, and an attorney under the Powers of Attorney Act 1998 who is exercising power, are served the same way.
  2. The opinion is not served on the defendant. The direction says the plaintiff should ordinarily provide an opinion of counsel. In some circumstances the opinion may be from a solicitor who is an accredited specialist in personal injuries, or an experienced personal-injuries solicitor. Unless there are exceptional circumstances, that solicitor is independent of the firm which took the instructions or prepared the matter.
  3. The sample orders say the plaintiff's solicitors serve a copy of the order on the trustee within seven days. That is in the sample orders. District Court Practice Direction 6 of 2018 paragraph 2 says paragraphs 3 to 12 of the Supreme Court direction apply in that court, and its own sample orders also use seven days for service of the order.
  4. The tool prepares the list of who is served and the dates. It does not write the opinion, it does not write the material rule 98 requires, and it does not serve anyone.

Sources

Rule 98(2) requires material from the solicitor and a statement by the litigation guardian. The tool writes nothing in either. Those documents are not served unless the court orders.
