How AI is used
From the accident date the lawyer supplies, calculate three months for notice of the statutory-benefits claim to the relevant insurer, and 28 days where the claimant seeks weekly payments from the day after the accident. If the lawyer says the at-fault vehicle is unidentified or uninsured, calculate 28 days for a claim on the Nominal Defendant to receive weekly payments from the day after the accident. Also calculate 28 days to report the accident to police unless the lawyer says a police officer attended. Do not decide that a late notice is barred.
What the lawyer must review
The lawyer confirms the accident date, whether weekly payments from the day after the accident are sought, whether the vehicle is unidentified or uninsured, and whether a police officer attended. Part 4 of the Motor Accident Guidelines says that, in accordance with section 6.8, a claimant verifies the motor accident before making a statutory-benefits claim by reporting it to the NSW Police Force within 28 days after the accident, unless a police officer attended, and by providing the accident event number if available. If the number cannot be provided, clauses 4.12 and 4.13 set out further information the insurer may request and what the claimant must then provide. Those clauses are applied by the lawyer. Clause 4.15, referring to sections 6.12 and 6.13, says notice of a statutory-benefits claim is given to the relevant insurer within three months after the accident, or, to be entitled to weekly payments from the day after the accident, within 28 days after the accident. Clause 4.16 says that where the at-fault vehicle is unidentified or uninsured, the claim is made on the Nominal Defendant within 28 days after the accident to be entitled to weekly payments from the day after the accident. A SIRA guide for accidents before 1 December 2017 states a different, six-month claim time and is not used for an accident on or after that date.

Checklist

  1. Keep the three-month notice and the 28-day weekly-payment entitlement as the guideline states them. Do not collapse them into one date.
  2. Use the Nominal Defendant 28-day weekly-payment date only if the lawyer says the vehicle is unidentified or uninsured.
  3. Do not apply the six-month time in the pre-1 December 2017 guide to a later accident.
