Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the records the lawyer selects, list the injuries, the treating documents, and the questions the lawyer has already written. Do not give a percentage and do not say whether a threshold is met.
- What the lawyer must review
- Choose the questions, the records, and any percentage the form asks the lawyer to suggest.
- The tool does not state a threshold result or adopt a percentage from a report.
- A permanent-impairment decision is the exception to internal review. Check that exception.
- Keep medical details in the firm's system. Apply ASCR rule 9, APP 11, and the Privacy Act notifiable-breach test.

The work product
Forum. Personal Injury Commission medical dispute in the motor accidents 2017 scheme
Produce. A list of injuries, documents and the lawyer's questions. No percentage is adopted.
Have ready. Records the lawyer selects; Questions the lawyer has written; Whether the insurer's decision was about permanent impairment.
Example of the limit. Illustrative example: The lawyer has written a question about whether treatment is reasonable and necessary, and a report states 8 per cent. The tool lists the question and records 8 per cent as the report's figure. It does not say a threshold is met.
Stop and hand it back when
- The tool is asked to give its own percentage or to say a threshold is met.
- The decision is not about permanent impairment, no internal review has occurred, and the tool is asked to ignore that step.

Checklist
- A claimant may ask the Commission to assess the degree of permanent impairment, whether treatment or care is reasonable and necessary or relates to the injury, whether treatment will improve recovery, impairment of earning capacity, or whether the injury is a threshold injury.
- The dispute is not referred until the insurer has internally reviewed the decision, unless the decision is about permanent impairment, the insurer has not finished the review in the required time, or the insurer has declined to review. The application should be lodged as soon as practicable after the review, the decline, or that due date. The page states no fixed number of days.
- Documents go in one indexed, categorised and paginated bundle, without duplicates. More than 500 pages depends on rule 67C(2), which was not opened. A reply is due 14 days after registration for a non-binding opinion, and 21 days for other matters.
- The page misprints the Act title. The Act is the Motor Accident Injuries Act 2017. A percentage printed in a report is recorded and not adopted. The tool does not say a threshold is met.
