Checklist
- Practice Note SC CL 3 paragraph 3.2 expects that, when a writ in a List is served, the plaintiff can serve a statement of claim in the time the 2025 rules allow, can serve critical documents, including relevant medical and economic-loss records, with the statement of claim, and, where appropriate, can serve a Wrongs Act certificate of assessment.
- The key documents file should not include medical records or tax documents as a matter of course. Do not paste them into that file to stand as particulars.
- County Court General List standard orders allow updated reports and final particulars of special damages, loss of earnings and loss of earning capacity within 28 days of trial.
- Those orders do not allow a new expert, or wholly new material, without leave.
