Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the dated documents the lawyer selects, set out what the claimant knew and did between the accident and the notice. Leave blank every part the claimant must sign.
- What the lawyer must review
- You decide whether the excuse is reasonable. The insurer decides whether to accept it.
- Where the vehicle cannot be identified, check the three-month notice and the nine-month bar.
- You place the excuse where the form asks for it. The tool does not.
- Use a firm-controlled tool. Check ASCR r 9, APP 11 and any notifiable breach.

Produce. A dated explanation for the lawyer to place on the form. Nothing is signed.
Have ready. The accident date; The notice date; The documents showing why notice was late.
Example of the limit. Illustrative example: The crash was on 1 January 2026 and the notice is dated 1 December 2026. The note lists the hospital admission in February and the first lawyer meeting in November. It does not say the excuse is reasonable.
Stop and hand it back when
- The accident date or the notice date is missing.
- The vehicle cannot be identified and the nine months have passed. The lawyer must see section 39(8) before any excuse is prepared.

Health, wage and scheme records stay in a firm-controlled tool. Check ASCR r 9, APP 11, and whether a disclosure is notifiable under the Privacy Act 1988 (Cth).
Section 37(2)(a) requires notice to the Nominal Defendant within 3 months after the accident where the vehicle cannot be identified. Otherwise, section 37(2)(b) requires notice within the period ending on the earlier of these dates. The first is 9 months after the motor vehicle accident or, if symptoms of the injury were not immediately apparent, the first appearance of symptoms. The second is 1 month after the claimant first consults a lawyer about the possibility of making a claim. If notice is late, the obligation continues and a reasonable excuse must be given in the notice or by separate notice to the insurer. If the vehicle cannot be identified and notice is not given within 9 months after the accident, the claim against the Nominal Defendant is barred. Section 39(8) says that, for that unidentified-vehicle failure, the Nominal Defendant cannot waive the time requirement and the court cannot give leave despite the noncompliance.
The Commission's claim page says the form has a section labelled Additional information/excuse for delay, that the insurer decides whether the reason is acceptable, and that a child's age is often relevant to a late notice.
