What the lawyer must review
  • You set the offer figure and you sign the certificate of readiness.
  • You write the verifying statement and the costs statement. The tool does not.
  • Do not start the proceeding while the mandatory final offer remains open.
  • Use a firm-controlled tool. Check ASCR r 9, APP 11 and any notifiable breach.

Section 51A requires a compulsory conference before the action. Either party may call it at an agreed time, or after the relevant date: 6 months after the notice, or, if additional information was required, the later of that date and 1 month after the completed form. The parties may dispense with it by agreement for good reason. The court may fix the time and place, or dispense with it for good reason, and must take compliance into account. Section 51B(5) requires, at least 7 days before, copies of documents not yet given, a statement verifying that all relevant documents have been given, details of legal representation, and, if a lawyer acts, a certificate of readiness signed by the lawyer. Section 51B(6) and (7) set out what that certificate and the costs statement must state. The lawyer writes them.

Section 51C requires a written mandatory final offer if the claim does not settle, at the conference or within 14 days after a dispensation. An offer at or under the upper offer limit is exclusive of costs. Between the lower and upper limits, costs follow the regulation. Those dollar limits are not in the section text opened. An insurer that denies liability still offers, expressed as nil. The offer stays open for 14 days and proceedings must not be started while it is open. Each copy is filed in a sealed envelope, the claimant's at the start of the proceeding and the insurer's before or with the defence. The court must not read them until it has decided the claim, and then has regard to them on costs. The court may dispense with the offers.
