The work product
Forum. Queensland plaintiff personal injury intake
Produce. A list of the likely respondent and the body that may pay, matched to the Act the lawyer names. Nothing is sent.
Have ready. The incident facts the lawyer selects; The Act the lawyer names, and whether any vehicle is unidentified or any employer is a self-insurer.
Example of the limit. Illustrative example: The vehicle that caused the injury was not identified. The list names the Nominal Defendant for a section 37 notice, and it does not name a CTP insurer that is not on the facts.
Stop and hand it back when
- The vehicle's identity, or whether the employer is a self-insurer, is unknown.
- The draft is about to be sent as a notice.

Checklist
- For a motor accident damages claim, Motor Accident Insurance Act 1994 section 37 is notice to the insurer, or to the Nominal Defendant where the vehicle is unidentified. Do not collapse those two.
- For a work injury, the damages notice under Workers' Compensation and Rehabilitation Act 2003 section 275 goes to the insurer. A copy goes to the employer where the employer is not a self-insurer. This task does not prepare that notice.
- For a claim to which the Personal Injuries Proceedings Act 2002 applies, the part 1 notice is given to the proposed defendant once that person is identified. Section 6 may take the claim against an employer outside that Act.
- The list uses only a body the facts and the Act support. It does not decide who is liable and it does not send anything.

WorkCover Queensland is the insurer only where the lawyer says it is. A self-insurer is a different body.
No notice is sent from this list. The notice tasks are separate, and each has its own time limit.
