From the instructions, list whether the person is described as a federal employee, whether the injury is said to have been sustained in the performance of duty, and which of the three § 8102(a) exceptions the file mentions. List the administration steps the Department of Labor page actually states. Do not invent a form or a time limit.
What the lawyer must review
5 U.S.C. § 8102(a) says the United States shall pay compensation for the disability or death of an employee resulting from personal injury sustained while in the performance of duty, unless the injury or death is caused by willful misconduct of the employee, caused by the employee’s intention to bring about the injury or death of himself or of another, or proximately caused by the intoxication of the injured employee. The Department of Labor page says FECA Claims Administration adjudicates new claims, pays medical expenses and compensation, and helps injured employees return to work when medically able. You decide where the claim is lodged. Do not copy a Comcare step list into a FECA file.
