How AI is used
From the plan, any nominee appointment, and any Victorian guardianship, administration or supportive order, list who the documents name and which decisions those documents cover. Do not say who should decide.
What the lawyer must review
  • Read the order for the class of decision, not for a general status
  • Do not treat a family member as a substitute decision-maker unless an order says so
  • Check whether legal proceedings are excluded unless the tribunal gives permission
  • Health records stay in the firm tool

The work product

Forum. Victoria. Guardianship List of the Victorian Civil and Administrative Tribunal.

Produce. A map of who each document names and which decisions it covers, with no recommendation.

Have ready. The plan and any nominee appointment; Any guardianship, administration or supportive order; The decision that has to be made.

Example of the limit. Illustrative example: An administration order covers financial decisions and says nothing about legal proceedings. The map records that limit. It does not treat the administrator as able to start a damages claim.

Stop and hand it back when

  • The order is not in the file.
  • The map treats a family member, or a nominee, as a guardian without an order that says so.

Checklist

  1. A guardianship order may cover one or more of health care, accommodation, employment, access to services, and access to people. It need not cover all of them. An administration order may cover financial decisions and may exclude matters such as legal proceedings unless the tribunal gives permission.
  2. A supportive guardianship or supportive administration order states which decisions the appointee can help the person make, and whether they may access information, communicate the person's decisions, or give effect to them. It is not a substitute appointment.
  3. An urgent guardianship or administration order can be made for up to 21 days and extended for a further 21 days. A guardian cannot be appointed only because a decision might be needed later. Guardianship is a last resort where there is no less restrictive way.
  4. Orders that are not self-revoking are reassessed within three years. Guardianship orders are often for up to one year. Administration orders are usually for three years where the need is likely to continue. Every order specifies a reassessment date, generally no later than three years.

The Office of the Public Advocate says that if a person cannot make a medical treatment decision, the Medical Treatment Planning and Decisions Act 2016 specifies who has authority. If there is no one, the Public Advocate can make significant treatment decisions without a guardianship order. The text of that Act was not opened.
