From the payment, the plan and the scheme the lawyer names, list whether the file shows a lump sum, a series of payments, or one of the New South Wales statutory schemes on the NDIA page, and the recoverable-amount facts that page states. Do not calculate a reduction.
What the lawyer must review
  • Decide whether the payment is compensation and whether the scheme is one the NDIA page lists for New South Wales.
  • Check who is repaid, the payer or the participant, from when the NDIA was told.
  • Do not calculate a recoverable amount or a compensation reduction amount.
  • Keep medical details in the firm's system. Apply ASCR rule 9, APP 11, and the Privacy Act notifiable-breach test.

Checklist

  1. The compensation page describes a lump sum, a series of payments, or ongoing supports from a government insurance scheme. It calls those schemes statutory schemes.
  2. For New South Wales, the statutory-scheme page lists the SIRA workers compensation scheme, the SIRA compulsory third party scheme, icare Workers Care, icare CTP Care, and icare Lifetime Care and Supports Scheme.
  3. A recoverable amount is not more than the supports funded for the injury, from the later of first NDIS use and the injury until the day before the claim was finalised. Recovery is from the payer if the NDIA was told before finalisation, and from the participant if told after the participant was paid.
  4. A compensation reduction amount is a separate adjustment of plan funding. The calculator is an estimate. The page says the NDIA cannot replace supports the statutory scheme already gives, and that a scheme appeal comes before a request for similar NDIS supports.

Sources

The compensation page, opened on 23 October 2026, says the NDIA is updating pages for new NDIS legislation and that some information may change. The statutory-scheme page spells the lifetime scheme as Lifetime Care and Supports Scheme. No compensation rule in the Act was opened, so no divisor or percentage is stated.
