- What the lawyer must review
- Article 69, 10 U.S.C. § 869, is a review by the Judge Advocate General. It is not the Court of Criminal Appeals or Court of Appeals for the Armed Forces path in Articles 66 and 67. On an application, the Judge Advocate General may modify or set aside the findings and sentence of a summary court-martial, or, for a general or special court-martial, order review under Article 66. An application must be submitted within one year after completion of Article 64 review for a summary court-martial. For a general or special court-martial it is one year after the end of the 90-day period that begins when the accused is notified of appellate rights under Article 65(c), unless the accused waived or withdrew appellate review under Article 61 before that notice, in which case it is one year after entry of judgment under Article 60c. The Judge Advocate General may extend for good cause, but may not consider an application more than three years after the applicable date. In a case reviewed under Article 64, the grounds for setting aside are newly discovered evidence, fraud on the court, lack of jurisdiction over the accused or the offence, error prejudicial to the substantial rights of the accused, or the appropriateness of the sentence. In a case reviewed under Article 65(b), review is limited to whether a waiver or withdrawal of an appeal was invalid. You write the application.
