- Index each document by date, source and a short label of what it is. Do not add a narrative.
- What the lawyer must review
- The index is a finding aid for counsel. It uses the labels on the documents. It does not become a filing, a charge sheet or the member's account. Opinion 512 still requires you to check that the index does not invent a document that is not in the set. If the record is for a court-martial, Article 16, 10 U.S.C. § 816, is the classification of the court. The index does not choose the forum. Keep the record out of a public tool (Model Rule 1.6).
