List the claims the papers describe and whether the papers already state the value of the vessel and pending freight. Write no figure and no sentence of a petition.
What the lawyer must review
46 USC section 30523(a) provides that, except as provided in section 30524, the liability of the owner of a vessel for a claim described in subsection (b) shall not exceed the value of the vessel and pending freight. The proportionate share of any one owner does not exceed that owner's proportionate interest in the vessel and pending freight. Subsection (b) covers claims arising from loss of or damage to property shipped on board, collision, or other loss incurred without the privity or knowledge of the owner, unless otherwise excluded by law. Subsection (c) says the limit does not apply to a claim for wages. Section 30524 was not opened, so this task does not apply the general limit to a personal-injury amount. The section states no tonnage formula and no filing deadline. You decide whether limitation is available. The tool writes no petition.
