- How AI is used
- From the rest plan and the hours record, mark whether each person the plan covers is described as an officer in charge of a navigational or engineering watch, a rating forming part of such a watch, or a person designated for safety, pollution-prevention or security duties, and whether the plan shows at least 10 hours of rest in each 24-hour period and 77 hours in each 7-day period. Do not decide that the rule applies.
- What the lawyer must review
- 46 CFR section 15.1111(a) requires every person assigned those duties on any vessel that operates beyond the boundary line to receive a minimum of 10 hours of rest in any 24-hour period and 77 hours of rest in any 7-day period. The boundary line is described in part 7, which was not opened. Subsection (b) allows the rest to be divided into no more than two periods in any 24-hour period, one of at least 6 hours, with no more than 14 hours between consecutive periods. Subsection (c) says the requirements need not be maintained in an emergency, a drill, or other overriding operational conditions. Rest may not be devoted to watchkeeping or other duties. The master must post watch schedules and keep daily rest records that the master, or a person the master authorizes, and the seafarer endorse. The master may suspend the schedule for the immediate safety of the ship, persons, or cargo, or to assist a ship or person in distress, and must then provide an adequate period of rest. In exceptional circumstances the master may authorize the exceptions in subsection (j), including the two-period limit on exceptions to the 10-hour rule, the 70-hour floor in any 7-day period, and the two-week limit on exceptions to the 77-hour rule. Subsection (e) keeps watchkeeping personnel subject to 46 USC section 8104. You decide whether the rule applies to these persons and whether an exception was authorized.
