In the marketing copy the lawyer supplies, list each sentence that offers a bet or wager, or that describes acceptance of credit, an electronic fund transfer, a check, or a similar instrument, with the page. Do not say the copy is lawful.
What the lawyer must review
18 U.S.C. 1084(a) provides that whoever, being engaged in the business of betting or wagering, knowingly uses a wire communication facility for the transmission in interstate or foreign commerce of bets or wagers or information assisting in the placing of bets or wagers on any sporting event or contest, or for the transmission of a wire communication which entitles the recipient to receive money or credit as a result of bets or wagers, or for information assisting in the placing of bets or wagers, shall be fined under that title or imprisoned not more than two years, or both. Subsection (c) provides that nothing in the section creates immunity from criminal prosecution under any laws of any State. 31 U.S.C. 5363 provides that no person engaged in the business of betting or wagering may knowingly accept, in connection with the participation of another person in unlawful Internet gambling, credit or its proceeds, an electronic fund transfer or funds transmitted by or through a money transmitting business, a check, draft, or similar instrument, or the proceeds of any other form of financial transaction prescribed jointly by regulation. The definition of unlawful Internet gambling is in section 5362, which was not opened. The list does not decide that the copy describes a prohibited transmission or a prohibited acceptance. The lawyer does.
