Index protests filed on an alcoholic-beverage license application
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Build an index of each protest the lawyer supplies, recording the applicant name and premises address as written, the grounds stated, the number of signatures, and the date the lawyer records as the date of filing. Do not decide that a protest is timely, valid, or abandoned. State law governs, and the lawyer confirms the governing state. For example, California.
- What the lawyer must review
- Alcohol licensing is a state matter under the Twenty-first Amendment. The California Department of Alcoholic Beverage Control states that anyone can protest an ABC license application, and that a protest must be filed with the Department by the close of business on the 30th day after notice is posted or mailed, whichever date is later. A protest must state the particular grounds and the facts that support them, the name of the applicant and the exact address of the proposed business, and the name, address, and signature of the protestant. Protests may be submitted only by individuals and may contain only one signature. Form ABC-510-A is not required. A timely protest is sent to the applicant. If ABC recommends issuing the license and the protestant does not wish to attend the administrative hearing, ABC states that the protest will be deemed abandoned and the license will issue. Person-to-person transfers of an existing license cannot be protested by the public. State law governs, and the lawyer confirms the governing state. For example, California.
