What the lawyer must review
18 U.S.C. § 1084(a) applies to a person engaged in the business of betting or wagering who knowingly uses a wire communication facility to transmit in interstate or foreign commerce bets or wagers, or information assisting in the placing of bets or wagers, on any sporting event or contest, or a wire communication which entitles the recipient to receive money or credit as a result. The punishment stated in the section is a fine under title 18, imprisonment for not more than two years, or both. Subsection (b) does not prevent news reporting, or transmission of information assisting bets from a state or foreign country where betting on that event is legal into a state or foreign country where such betting is legal. The section creates no immunity from state prosecution. 31 U.S.C. § 5363 separately provides that no person engaged in the business of betting or wagering may knowingly accept credit, an electronic fund transfer, a check or similar instrument, or another financial transaction prescribed by the Secretary and the Federal Reserve, in connection with another person's participation in unlawful Internet gambling. The definition of that term is in § 5362, which was not opened. You decide whether either section is engaged and you write any response.
