- How AI is used
- List the states the lawyer names for the promotion, and leave a column for the license, disclosure, or bond the lawyer finds in that state's law. Do not say a federal permit exists and do not say a purchase requirement is lawful.
- What the lawyer must review
- The Federal Trade Commission's Advertising FAQs, checked on 22 October 2026, state that sweepstakes-type promotions that require a purchase by participants are illegal in the United States, that other agencies including the United States Postal Service and the Federal Communications Commission also enforce federal laws governing contests and prize promotions, and that each state has laws that may require promoters to make disclosures, seek licensing, or post a bond. The same page says state laws vary and that the promoter should check the attorney general's office in the states where it plans to advertise. The Telemarketing Sales Rule and the 900 Number Rule are mentioned on that page and were not opened. ABA Formal Opinion 512 (29 July 2024) leaves the lawyer responsible for the map. The lawyer decides which state requirements apply. The map does not.
