How AI is used
Extract every case name, statute, quotation and factual assertion into a list for the lawyer to open. Change nothing in the document.
What the lawyer must review
If you present the paper to a federal court, by signing, filing, submitting or later advocating it, you certify under Rule 11(b), after an inquiry reasonable under the circumstances, that it is not presented for an improper purpose, that the legal contentions are warranted by existing law or a nonfrivolous argument for changing the law, that the factual contentions have evidentiary support or will likely have it, and that denials are warranted on the evidence. Model Rule 3.3 forbids knowingly making a false statement of fact or law to a tribunal or failing to correct a false statement of material fact or law you previously made. Model Rule 8.4(c) prohibits conduct involving dishonesty, fraud, deceit or misrepresentation. Formal Opinion 512 says generated output has included citations to nonexistent opinions and inaccurate analysis, and that even an unintentional misstatement to a court can be a misrepresentation under Rule 8.4(c). You check every authority in a reporter or an official source. Asking another generative tool whether a citation is real is not the check. Some courts require disclosure of generative-AI use. Opinion 512 says to consult the court's local rules. You do not file the client's draft unchanged.
