- How AI is used
- From the time records and the draft request, list the tasks, the time, the rates, whether the request is compensation for services or reimbursement of expenses, whether the work is already done or still to be done, any cap the lawyer supplies, and who is employed. Do not say the fees are reasonable.
- What the lawyer must review
- You decide what to request, and the court awards it. 11 U.S.C. § 330(a)(1) says that after notice to the parties in interest and the United States trustee and a hearing, and subject to sections 326, 328, and 329, the court may award to a trustee, a consumer privacy ombudsman appointed under section 332, an examiner, an ombudsman appointed under section 333, or a professional person employed under section 327 or 1103 reasonable compensation for actual, necessary services, and reimbursement for actual, necessary expenses. Section 330(a)(3) lists factors for an examiner, a trustee under chapter 11, or a professional person, including time spent, rates charged, whether the services were necessary or beneficial when rendered, whether they were performed in a reasonable time, professional skill, and whether the compensation is reasonable based on customary compensation charged by comparably skilled practitioners in cases other than cases under title 11. Section 330(a)(4)(A) says the court shall not allow compensation for unnecessary duplication, or for services that were not reasonably likely to benefit the debtor's estate or necessary to the administration of the case, except as subparagraph (B) provides for an individual debtor's attorney in a chapter 12 or 13 case. Federal Rule of Bankruptcy Procedure 2016(a) requires an application for interim or final compensation or reimbursement of necessary expenses from the estate to show the amounts, services, time, and expenses; payments previously made or promised; the source; whether previous compensation has been shared; whether a sharing agreement exists; and the particulars of any sharing, except with a member or regular associate of a law or accounting firm. Except in a Chapter 9 case, a copy goes to the United States trustee. The opened text does not provide for a creditor resolution approving the fees.
