- From the compensation application, list the amounts requested, the services, the time, the expenses, the payments already made or promised, and any sharing arrangement the application states. Do not decide that less should be awarded.
- What the lawyer must review
- You decide whether to ask the court to award less, and the court decides the amount. 11 U.S.C. § 330(a)(2) says the court may, on its own motion or on the motion of the United States trustee, the United States trustee for the district or region, the trustee for the estate, or any other party in interest, award compensation that is less than the amount requested. The checklist of what that request answers is Federal Rule of Bankruptcy Procedure 2016(a): the application must show in detail the amounts requested and the services, time, and expenses; all payments previously made or promised for services in connection with the case; the source of that compensation; whether any previous compensation has been shared; whether a sharing agreement or understanding exists; and the particulars of any sharing, except with a member or regular associate of a law or accounting firm. Except in a Chapter 9 case, the applicant must send a copy to the United States trustee. The opened text does not create an office of reviewing liquidator, a six-month or 12-month filing window, or a declaration of relevant relationships.
