From the issues list the lawyer approves, draft topics and a document list limited to the matters Rule 2004(b) allows. Do not issue a subpoena.
What the lawyer must review
On a party in interest’s motion, the court may order the examination of any entity (Rule 2004(a)). The examination may relate only to the debtor’s acts, conduct or property, liabilities and financial condition, any matter that may affect administration of the estate, or the debtor’s right to a discharge, plus the further matters in Rule 2004(b)(2) in a chapter 12 or 13 case or a chapter 11 case that is not a railroad reorganisation. Attendance and documents may be compelled under Rule 9016, and an attorney admitted in the court where the case is pending may issue and sign a subpoena on behalf of that court (Rule 2004(c)). A non-debtor witness is required to attend only if the lawful mileage and one day’s witness fee are first tendered. The lawyer decides the scope and signs any subpoena.
